Following a read of the Electronic Fronteir Foundation (EFF) press releases http://www.eff.org/press/releases I was confused as to why it wasn’t easier to legislate against piracy, specifically peer to peer network misusage.

“It’s crucial that courts continue to protect emerging technologies that are capable of substantial lawful uses, even if they also can be used in less acceptable ways,” said EFF Senior Intellectual Property Attorney Fred von Lohmann.”

Well obviously. No one is suggesting that someone comes up with a definition of a peer to peer network and then criminalize taking part in, running, or conspiring to run such network. Why not just define more clearly how peer to peer is often used for piracy and legislate against that?

“In Arista v. Lime Wire, the recording industry plaintiffs seek to hold Lime Wire liable for acts of copyright infringement by users of its software.”

By all means target the Companies who host the networks that pirate users operate on. Obviously no well known service such as Lime Wire ever actively promotes piracy though. On a network however where any user can upload or download any software, videos, music and pictures what do you think is going to happen? Surely without needing to legislate against peer to peer technology itself, it’s clear that the network operators are failing to uphold their duty of care to their Clients in providing a reasonable level of protection.

The average end user who downloads pirate music or videos often doesn’t even consider that what he’s doing is actually illegal, let alone making a conscious decision to ignore it, after all, it’s so simple and easy with some desktop software and a choice of anything to search for and download.

Network operators and software developers should be required to inform the users of their duties in ensuring that they avoid downloading pirate material in simple and proper terms. Uploads should be examined and changed to make the pirating process harder. Software guards should be put in place against piracy and searches for obviously pirated material should be filtered. With that in place as a reasonably responsible approach from the operators, users that actively ignore and bypass or attempt to bypass such safeguards to upload or download pirate material can be targeted.

What should you work on first, is this ever a question that runs through your mind? Well trust me it ran through mine countless times. So, the content is quite good. The things that i don’t like, is the lack of videos. However the informations is quite well documented and the infos is easy to follow. Just tested it on my human lab last week, so i took a new infopreneur tht i coach and asked him to follow the guideline. After two weeks, the conclusion was quite surprising. Two new products created and sales for 1,265$. I am quite impressed, didn’t expect these kind of results that fast. So for me the system described work, but you must follow each step to get the same results. I will rate it 9/10; and the pricing is just too low in my humble opinion.

Siobhan O'Mahony, an assistant professor at the School of Management of the University of California, Davis, calls Mozilla 'the first corporate open-source project.'

The foundation has used a for-profit subsidiary, the Mozilla Corporation, to collect tens of millions of dollars in royalties from search engine companies that want prominent placement on the browser. And by collecting that money as a war chest to compete against giants like Microsoft and Apple, the foundation has, at least temporarily, moved away from the typical activities of a nonprofit organization. 'The Mozilla community has been a bit hybrid in terms of integrating public and private investment all along -- its history is fairly unique in this respect,' Professor O'Mahony said."

Unique maybe in the sense that it's achieved so much success, but it's nonsense that the notion of a public-private partnership to create open source products is "unique" or that Firefox was first. If the writer had gone further afield than UC Davis, that worldwide center of excellence in open source, he might have been able to get quotes to that effect. But I suspect what really happened here is that the reporter started with a thesis he invented while sitting with his feet up on a desk in the newsroom ("hey! Firefox makes money somehow!") and then sought out quotes trying to validate the overall amazingness of his thesis. This is a story that's been around for years and the writer didn't add much to it here.

For my money, MySQL AB is a much more interesting story of a for-profit company using open source, particularly since they've done such a terrific job disrupting the database market (and, unlike Mozilla, could go public soon). Alfresco is also particularly interesting in the sense that it's comprised of a bunch of pioneers in the content management field who are using an open-source content management product to disrupt their former closed-source companies.
